So as a legal medicinal user does this mean if I get stopped for what ever reason and local authorities smell marijuana in my vehicle and want to do this test I am legally able to refuse? as marijuana is my medication and I am legally allowed to consume

Technically whether medical or not, your not supposed to operate anything impaired. If I'm not mistaken.
That being said I would assume you can't. Maybe it'll be like an alcohol test, you can refuse then they'll get
a warrent to take blood...

You can refuse, but it'll probably be like refusing to blow into a breathalyzer. Instant license suspension. Now whether they charge you with dui or not at that point remains to be seen, but I'm guessing they will.

You are legal to posses and use, but operating under the influence is still illegal. (Which I strongly oppose, as cannabis use is not a detriment to driving ability like alcohol is... But try convincing the cops and courts of that.)

If they can put you through the meat grinder, they will.

Yes all your points are valid. But
If its in your system for 2 hours thats where the problem occurs. .
Medicinal marijuana does not get you high.
It has small traces of thc in it. 1% to 5% the rest is cbd
So I can fully function with the medicine that I have as it is geared to my ailments not to get me high.

There is going to be alot of grey area with this device.
Alot of wasted tax payers money

The stuff I use anyway does not have high thc.
Its 98% cbd
They will have to set a limit of thc before you "blow over"

Not to mention my wife is also a card holder.
So even if I dont ingest it im around it!
Hers is HIGH thc!

I can understand the point of the people using it for medical purposes where it is going to be a problem
If Canada legalizes the use of Cannabis then we do need something to help keep the high people from driving

I agree 100%
But as of right now I can see alot of holes in this device already.
IE: if more then one person is a card holder and they are traveling together etc etc

I don't see a problem with experienced users driving while under the influence of cannabis. If it were that big of an issue, like drunk driving, then we would have already seen the carnage on the motorways. Just because it's currently illegal, doesn't mean that there aren't a million people doing it everyday already. If high driving were a legitimate concern the prohibitionists would have been dragging the resulting bodies through the streets, and the media. Hasn't happened because it isn't a real threat.

Not a cardholder, but I am in BC. :)

im not ranting on this device at all i think its a good thing!

but the rules need to be cut and dry before this device is going to be used..
and i cant seem to find a whole lot about it!

my wife and i live in a small 1 bedroom apartment when she needs to do her medicine she does it!
im not going to leave the apt and wait outside until she is done her medicine so i don't accidentally ingest a cloud of marijuana before we go out to dinner or a movie etc etc..


you have to look at is this way!

she needs to do her medicine before we leave to do what ever we are doing for the day.
i stay with her in the apt do not ingest ANY marijuana. For some reason get pulled over.
local authorities smell cannabis when the window comes down!
excuse me sir have you been smoking anything today. do you mind if i use this device on you as i smell marijuana (if i say no that opens a whole world of problems)
no officer i did not have any marijuana today!
well im sorry this device says otherwise!!

now its my word against the officers!
time is lost at work in court defending yourself for something you have not done! (i know it happens everyday)
but the rules need to be set before this device should be used!

They just want to continue to jam up law abiding citizens in the name of safety. They'll arrest you for that pot whether it's legal or not because the system needs to be fed.

been a heavy smoker for over 30 years.. never smoked so much that it affected my driving.. did all the 'high work for my tree svc for the same 30 yrs, & never had 1 serious accident on the job, except a collapsed bucket truck(too much smoke in my lungs!) .. this whole thing is a scam to rob u of your hard-earned cash.. nothing more..:rolleyes:

My father in law was heavy drinker and drove under the influence for years. He never got into a accident doesnt mean it was safe for the rest of the drivers on the road when he was driving!!!!!
